ESG Program Development: Anti-Forced Labor and Supply Chain Due Diligence

U.S. Customs and Border Protection (“CBP”) reported nearly 2,200 shipments, valued at $728 million, were suspected of containing goods subject to the UFLPA. The auto-industry also recently fell under public scrutiny; however, CBP’s scope regarding forced labor remains broad, including sugar and tomato products, solar panels, electronic components,  and garments. CBP’s continued enforcement of the Uyghur Forced Labor Prevention Act (“UFLPA”) and Withhold Release Orders (“WRO”) demonstrate the need for importers to navigate the evolving anti-forced labor space while continuing to mitigate risk within the supply chain.  Effective supply chain solutions will require importers to implement cross-functional anti-forced labor teams within broader ESG strategies to overcome complex obstacles required by the UFLPA.
